Bareilly Court Jails Woman, Fines Rs 5.9 Lakh for False Rape Acquisition

In a long-haul verdict, Bareilly Court has sentenced a woman to jail time and a hefty fine for fabricating a rape accusation. The judgement, delivered by Additional District Judge Gyanendra Tripathi, offers a measure of justice to Ajay Kumar (alias Raghav), who was wrongly imprisoned for over 4 years based on a fabricated claim.

The case unfolded in 2019 when the woman, a colleague of Ajay, was accused of kidnapping and raping her 15-year-old sister. Her initial statements to the police and court were damning, leading to Ajay’s arrest and subsequent jail-time.

However, the case took a dramatic turn when the woman recanted her statements during the court proceedings. Contrary to her earlier claims, she asserted that Ajay had not committed any wrongdoing against her. This revelation not only led to Ajay’s release but also raised questions about the severity of the accusations put against him.

After the release, Ajay filed a complaint against the woman for misleading the court. And after the judges came to the decision according to which the false accuser has to serve the same jail-time as Ajay, which is 1,653 days. In addition to the custodial sentence, she was also fined Rs 5,88,822, with the imposition of an additional penalty in case of non-payment of the fine.

Judge Gayanendra Tripathi, while delivering the verdict, emphasized the need for exemplary punishment to deter individuals from abusing the law. This verdict underscores the profound consequences, emphasizing the imperative of preserving the sanctity of justice.

 “Govt and judiciary ensure strict action in women-related complaints, but that doesn’t mean that women, who intend to take undue advantage of the law, will be given to impact the rights of men,” the court added. 

The verdict was met with mixed emotions, with many lauding it as a step towards accountability and justice.
