Punjab HC Directs DGP: Banned Songs Details

In a recent development, the Punjab and Haryana High Court has taken a significant step towards addressing the issue of songs that promote the glorification of weapons and violence in the region. 

The Court has directed the Director General of Police (DGP) of Punjab to submit an affidavit containing detailed information regarding the songs that have either been banned or recommended for ban due to concerns raised over the adverse impact of such songs on society, particularly in Punjab.

The Punjab Government had previously issued a directive in November 2022, imposing a complete ban on the public display of weapons in songs that glorify violence. However, the court has sought clarification on the procedure adopted to enforce this ban, taking into consideration the constitutional provision under Article 19 of the Indian Constitution. 

Additionally, the court has requested information on the number of live shows of public events where complaints regarding the glorification of violence in songs have been received, wither from the public or from law enforcement agencies.

Justice Harkesh Manuja, presiding over the bench, has emphasised the need for a comprehensive affidavit from the Punjab government, noting that previous submissions lacked coherence and provided information only in fragments. 

In a related manner, the court had previously raised concerns over the widespread use of firearms in public events and marriages, despite the government’s ban. As part of its ongoing scrutiny, the court has requested the DGP to provide details on the identification of anti-social elements and the criteria used for defining them.

Furthermore, the court has sought data on FIRs registered for the unlawful use and display of firearms in public spaces, religious gatherings, marriage ceremonies, and social media platforms. This holistic approach underscores the court’s determination to address the issue of violence-promoting songs and ensure strict enforcement of laws pertaining to public safety and security.

The matter is scheduled for a further hearing on May 13, where the court expects to receive an affidavit from the Punjab DGP.
